Recent Florida Probate Case Illustrates Problems with DIY Wills

The link I've posted here goes to a discussion of a recent case in Florida in which a woman made her own will using a will kit. There was nothing wrong with the kit itself, but the woman didn't understand what she was doing. As a result, the will ended up in court with her husband and other family members duking it out.

The mistake she made in the document itself was to fail to include a clause dealing with the residue of the estate. I've personally seen several home-made wills that have made the same mistake, so I know it's a common error.

I'm in favour of people doing things for themselves, as long as they find out how to do it right. Make sure you educate yourself as much as possible about wills if you plan to do your own. If you don't, it's your family left behind that pays the price.
