Kirk Makin of the Globe and Mail had an excellent article last week highlighting a recent case where the children were fighting over their mother's finances, while the 87-year-old mother suffered from dementia. I like the case, and the article, because the Judge was fed up with greedy children who didn't really care about the mother (Ida), who was stuck in the middle while her children eyed her bank accounts. He was tired of them dragging it through the courts and said:
"May I respectfully suggest that had any of the parties really cared about Ida's well-being, they would have moved heaven and earth to have had this matter adjudicated yesterday."
You go, Judge Brown!
I believe this case is part of a trend in Canadian jurisprudence towards noticing, helping and protecting elderly individuals. It's sad to see how many people are willing to fight tooth and nail for the money their parents have saved, while neglecting the parent completely. Or worse, using the parent as a weapon in the battle.
